The User accepts the following terms and conditions by visiting Website or ordering services via Prague Companions and/or its successors in title and/or legal entities/natural persons affiliated with it. The User also confirms being adult and legally competent.

Definitions
In these terms and conditions, the following terms have the following meanings:
Companion/Escort is a person with a minimum age of 21 years, who execute a Booking of the Client out of their own free will. This person is always represented by Prague Companions agency.
Client is a natural person with a minimum age of 21 years, who has expressed interest to conclude or have concluded a booking agreement with Prague Companions.
Booking is the agreement for assignment, and all other agreements between the Client and Prague Companions made via the Website, by email, telephone, WhatsApp, text message, or any other means of communication, in which the Client has the intention to make use of Prague Companions’ provision of service.
Booking Confirmation is a confirmation by Prague Companions to the Client in which the agreements with regard to a Booking between the Client and Prague Companions are recorded.
Booking Rate is a rate for the company of the Companion/Escort.
Additional Services are services provided by Prague Companions which do not refer to the company of Companion/Escort, but for example (special) transportation, travel itinerary, travel documents, special clothing, catering and/or stay, etc.
Articles
1.1 These Terms and Conditions apply to all offers issued or made by Prague Companions, as well as to all Bookings and legal relationships related thereto. Derogations from these Terms and Conditions will exclusively apply if and insofar as these are expressly approved in writing by Prague Companions.
1.2 Prague Companions will always be entitled to adjust the text of these Terms and Conditions and to unilaterally amend this. In that case the new text of these Terms and Conditions will apply.
1.3 The applicability of any other Terms and Conditions which the Client might want to use is expressly excluded.
1.4 The Client is deemed to agree to the exclusive applicability of these Terms and Conditions at the time of the coming into effect of each Booking, unless the Client and Prague Companions have expressly agreed otherwise in writing.
1.5 If one or more of the provisions of these Terms and Conditions are void or might be declared void, the remaining provisions of these Terms and Conditions will remain fully applicable. In that case Prague Companions and the Client will enter into consultation in order to agree on new provisions for the replacement of the void or voided provisions, whereby the purpose and meaning of the void or voided provision will be taken into account as far as possible
1.6 The Client who has already concluded a Booking with Prague Companions will be deemed to tacitly agree to the applicability of these Terms and Conditions to later and/or additional Bookings of and/or services to the Client concerned.
2.1 Prague Companions is a freelance online marketing agency promoting and offering escort service for couples, man and woman in Prague, Czech Republic. Agency can be reached via email: praguecompanions69@gmail.com. Opening hours are daily between 10.00 AM (ten o’clock in the morning) and 11.00 PM (eleven o’clock in the evening) CET/Prague time, the response time for this contact method is 6 hours.
2.2 Prague Companions can be reached via WhatsApp during opening hours on number +420 703 648 899.
2.3 Missed calls during opening hours are only returned, if possible, within 30 minutes of the missed call.
2.4 Contact via SMS or WhatsApp Voicemail messages are only answered if the message clearly includes a name.
Article 3. Responsibility and obligations of the Client
3.1 Article 10 of the CHARTER OF FUNDAMENTAL RIGHTS AND FREEDOMS as a part of the constitutional order of the Czech Republic states that: “(1) Everyone has the right to demand that his/her human dignity, personal honour and good reputation be respected, and that his/her name be protected. (2) Everyone has the right to be protected from any unauthorized intrusion into his/her private and family life”. This implies that it is laid down by law that the performance of sexual acts of any kind can never be enforced. Neither Client nor Prague Companions has any control over the nature and content of Companion’s activities during Booking. Companion/Escort acts at his/her own discretion and free will.
3.2 All services are provided at the discretion of the Companion/Escort. The offers on the Website are for time and companionship only. If anything else occurs it is a matter of choice between consenting adults. Anything implied or inferred within Prague Companions Website pages is not to be taken as an inducement for payment for anything other than time and companionship.
3.3 The Client is obliged to respect and comply with the rules of Prague Companions and the laws of the Czech Republic;
the Client is especially obliged not to demand sexual activity in meaning of Section 185 (Rape) and Section 186 (Sexual coercion) of Act No. 40/2009 Sb., the Czech Criminal Code as amended (hereinafter referred to as “CrC”);
not to spread or otherwise cause the spread of such diseases which are considered dangerous and contagious according to the currently valid and effective government regulation, within the meaning of Section 152 of the CrC, even through negligence pursuant to Section 153 of the CrC;
otherwise, the Client is fully responsible for his/her actions resulting in legal, penal, moral, reputational consequences.
Article 4. Responsibility and obligations of the Agency
4.1 Description of work - Agency. Work performed by Prague Companions includes the following:
Agency to perform internet marketing for independent Companion by driving internet traffic of potential clients interested in a date to the Companion’s profile on PragueCompanions.com Website;
Agency registers independent Companion/Escort on the PragueCompanions.com Website, keeping profile and photos of independent Companion up to date, content is submitted by independent Companion/Escort.
Article 5. Responsibility and obligations of the Companion/Escort
5.1 Companion/Escort is an independent contractor and is not an employee, servant, partner of Prague Companions. Companion/Escort is responsible for own liabilities as independent contractor.
5.2 Work performed by Companion/Escort includes the following:
- Escort to accompany the Client at dates, functions and parties
- Has control over what work she/he does
- Contacted for service on ad hoc basis
- Sets her/his own schedule
Article 6. Coming into effect of the Booking
6.1 All offers and tenders made by Prague Companions are without obligation, unless otherwise set out in the offer or tender.
6.2 A Booking will only come into effect at the time when Prague Companions has expressly accepted the Order or Assignment. The Booking Confirmation from Prague Companions will be deemed to correctly and completely represent the Booking, subject to obvious spelling and typing errors.
6.3 The Booking will be instead of and will replace all earlier proposals, correspondence, arrangements, or other communication, made in writing or as the case may be verbally.
6.4 Prague Companions, its directors and its staff reserve the right to refuse any Assignment at any time without notice or provocation, for whatever reason seems fit.
7.1 The profile of each Companion/Escort lists an overview of the rate per maximum duration.
7.2 The duration of the Booking which is decided before commencement of the Booking, is the “pre-booked duration”.
7.3 For Booking extension hourly extension rate applies. An overview and minimum booking duration can be found in Companion/Escort’s profile.
7.4 If the Client wishes to terminate the booking prematurely, there is no refund.
7.5 If the previously agreed Booking duration is exceeded with more than 15 minutes, this extension is subject to the hourly extension rate, unless the Client informs Companion/Escort or Prague Companions that she/he does not wish to extend previously agreed Booking duration.
7.6 In case of an Overnight, the Booking commences between 16.00 (4PM) and 23.00 (11PM) and ends between 6.00 in the morning and noon. The Client and Companion/Escort will spend the night together, during which the Companion/Escort can sleep at least 5 hours undisturbed.
7.7 If the Client has additional wishes that result in more work, time or costs for Companion/Escort or Prague Companions than may reasonably be expected, an increase in the applicable rates may be justified.
8.1 All payments must be made prior to the Booking or no later than immediately at the commencement of the Booking. The Client shall pay in cash also at the moment of an extension arrangement and confirmation by Prague Companion, prior extension commencement.
8.2 The Client will inform Prague Companions of the method of payment prior to the Booking - cash / crypto currency (USDT) transfer.
8.3 The availability of all payment options is not guaranteed and subject to availability. Prague Companions can limit the payment options for the Client and/or require a prepayment before the Booking, without providing a reason.
8.4 The services of Prague Companions are personal in nature and therefore not tax deductible for the Client if the Client uses the services of Prague Companions himself. In order to prevent fraud and to protect the privacy of the Client, no invoice is issued.
8.5 Prague Companions accepts cash payment in Euros, American dollars, British pounds or Czech kronas at the commencement of the Booking. When paying with Euros, €200 and €500 notes are not accepted. When paying with Czech kronas, American dollars or British pounds, the payment is based on the exchange rate applicable on the day of the payment (average validated via google.com search query). The value of the foreign currency that the Client wishes to use may not be less than €100 and no more than €2.000. The Companion/Escort does not carry any change.
8.6 Prague Companions does not accept payments by creditcard and debitcard.
Article 9. Booking requirements
9.1 A Booking requires a 2-hour minimum or longer, conform the information in the profile of Companion/Escort and other information on the Website.
9.2 An Assignment can be provided daily during Opening hours. The Client will notify Prague Companions (also) via telephone of any Assignment starting within 6 hours.
9.3 A booking cannot start between 24.00 and 8.00 in the morning/night (CET/Prague time zone). Bookings starting outside the Opening hours require a minimum of one hour longer than the regular minimum booking of Companion/Escort, conform the information in the profile of Companion/Escort and other information on the Website.
9.4 Bookings can only take place in hygienic dwellings, in a constructed immovable property or as the case may be a hotel/accommodation with a classification of at least four stars. This should at least consist of a bedroom for two persons with a sitting area and private bathroom and toilet. If a hotel room does not offer sufficient seating, the hotel bar or lounge can serve as a substitute to spend at least the first 30 minutes of the Booking. Bookings are never possible in flats (Airbnb etc.), unhygienic locations, unsafe areas, cars, rendezvous hotels, student housing, shelters, sex cinemas or locations with similar characteristics.
9.5 New Clients must cooperate in verifying the location of the Booking and the identity of the Client, by means of but not excluded by providing ID photo (via WhatsApp), proof of reservation location and/or verification of room number (by operator calling your hotel room land line while you are there).
9.6 No persons other than the Client are present during bookings at the booking location, unless otherwise agreed or in the case of a partners’ couple (Male + Female), a double booking or a public occasion.
9.7 If travel is necessary during Booking, this is possible on foot for distances shorter than 1 kilometre, weather and safety permitting. Distances longer than 1 kilometre can only be covered by car. A new Client must use a licensed and recognized taxi service (Uber, Bolt) and a safety tracker is shared with Prague Companions’ operator. In other cases, Companion/Escort can also ride with the Client in his (rental) car, provided the Client meets the legal requirements for driving a vehicle. Traveling via Public Transport is not possible.
9.8 If the Client fails to meet any requirement as stated in this Article 9, no claim can be made for free cancellation as set out in article 12.4 and the Client is offered a one-time opportunity to make sure the requirement(s) is/are met within a reasonable timeframe. The time spend is at the expense of the Client. If the Client is unwilling or not capable to meet the requirement(s), the Booking is immediately terminated without right to refund.
Article 10. Client requirements
10.1 The Client will handle all communication surrounding Assignment and/or Booking him/herself. It is not permitted to place an Assignment for a Booking by third parties, unless the Client is unable to do this due to a physical disability.
10.2 The Client needs to be at least 21 years old. In case of doubt about the age of the Client during the Booking, the Client will present a valid proof of identity to the Companion/Escort for inspection.
10.3 The Client must refrain from possession and/or, the use of and/or being under the influence of large amounts of alcohol and/or drugs. The Client must refrain from demanding and/or encouraging the Companion/Escort to consume alcoholic beverages and/or use of drugs.
10.4 The Client will ensure that during the Booking the Companion/Escort is accessible for Prague Companions and private calamities and has regular internet access.
10.5 The Client will treat the Companion/Escort with respect during the Booking and never force the Companion/Escort to perform acts that are in conflict with the Companion/Escort’s will or may otherwise be in conflict with the law.
10.6 The Client undertakes to provide a high level of (personal) care and hygiene prior the commencement of, and during the Booking and pay extra attention to the pubic and dental area.
10.7 At the time of the Booking request, the Client to notify Prague Companions of any medical complaints that could affect the health of the Escort or the Booking itself. Client must also report of any medical condition (incl. risk of flu/COVID-19) or complaints that may require medical intervention during the Booking.
10.8 The Client will refrain from requesting or demanding sexual acts during the first 30 minutes of the Booking, and make an effort to get to know the Companion/Escort on a mental level.
10.9 The Client will not ask for, demand or encourage (unsafe) practices with the Companion/Escort.
10.10 The Client will respect the privacy of the Escort and will amongst others things:
The Client will consider all information provided by Companion/Escort during the Booking as confidential and treat it as such.
The Client is never permitted to make any audio, video or photo recordings of Companion/Escort, or Companion/Escort of the Client, unless special conditions are agreed prior.
The Client is never permitted to ask Companion/Escort for the real name or undertake any attempt to obtain it.
The Client is never permitted to make direct contact with Companion/Escort, to exchange contact details, or to disclose his to the Companion/Escort.
The Client is never permitted to inspect the private properties (and contents of these) of Companion/Escort, such as (hand)bag, (hand)luggage and mobile phone. The Client will not inspect, copy or make these his own in any way.
The Client will only take Escort to social occasions where acquaintances, friends, family and/or colleagues of the Client are present, after explicit permission from and extensive consultation with Prague Companions and Companion/Escort.
The Client will allow Companion/Escort privacy during toilet- and bathroom use and telephone conversations of a personal nature and/or with Prague Companions, and stay away of the immediate proximity of Companion/Escort during these.
The Client will never disclose information in (public) reviews that could compromise the privacy of Companion/Escort to any degree, or which are of a very graphic nature. The Client will always inform Prague Companions of a (public) review and its content. The Client will immediately adjust the content of the review if, in the opinion of Prague Companions, it infringes the privacy of Companion/Escort and/or is too graphic in nature.
10.11 During a Booking, the Client will provide Companion/Escort with a drink of Companion/Escort’s choice at the commencement of the Booking every and every 2 following hours, at the Client’s expense.
10.12 During a Booking, Client will provide Companion/Escort with a meal every 6 hours, with a minimum of three meals per 24 hours at the Client’s expense.
10.13 During a booking with a duration of 12 to 24 hours, which takes place during common sleeping hours, Client will offer Companion/Escort at least 4 hours of uninterrupted sleep. During an Overnight booking Companion/Escort will be offered at least 5 hours of uninterrupted sleep.
10.14 During a Booking with a duration of 24 hours or longer, the Client will offer Companion/Escort at least 2 hours of undisturbed private time and at least 6 hours uninterrupted sleep per 24 hours.
10.15 The Client must always refrain from (any attempt to) misleading, harassment and/or other acts or omission which endanger the safety of Prague Companions and/or the Companions/Escorts engaged by it.
10.16 If a Client fails to meet any requirement as stated in Article 10, no claim can be made for free cancellation as set out in article 12.4 and the Client is offered a one-time opportunity to make sure the requirement(s) is/are met within a reasonable timeframe. The time spend is at the expense of the Client. If the Client is unwilling or not capable to meet the requirement(s), the Booking is immediately terminated without right to refund.
Article 11. Cancellation/change by Prague Companions
11.1 In the event of a change or cancellation of the Booking by Prague Companions, the Client will be contacted as soon as possible.
11.2 Prague Companions is always permitted to cancel, change or prematurely terminate a Booking if:
In the opinion of Prague Companions, the identity, integrity and/or safety of the Companion/Escort cannot be guaranteed during the Booking or when traveling to the Booking.
Companion/Escort indicates she is not physically or mentally able to execute the Booking, or the execution of the Booking is against the will, desire or comfort of the Companion/Escort. Companion/Escort is not required to stay with, accompany or converse with any Client she/he does not wish to stay, accompany or converse with, nor is she/he required to provide any particular services.
The location of the Booking is not available.
The Client does not fulfil the agreed terms and conditions of the Booking (within the period(s) set out for this purpose), or if there are good reasons that give cause to expect that the Client will not fulfil the agreed terms and conditions.
Circumstances occur as a result of which it cannot be reasonably expected form Prague Companions that it will fulfil its obligations of the Booking.
In the event that the Booking has already commenced and the Companion/Escort wishes to terminate the Booking prematurely, without there being any failure to comply with Article 9 and/or 10 by the Client, the time that the Client already spent with Companion/Escort will be charged to the Client, with a minimum of the minimum booking duration of Companion/Escort at the location of the Booking.
11.3 If the Booking can only take place under changed circumstances, the Client is permitted to cancel the Booking free of charge.
11.4 Prague Companions and Escorts are not liable for any direct or indirect damage suffered, or expenses incurred by the Client in the event of a cancellation/change by Prague Companions.
Article 12. Cancellation/change by the Client
12.1 In the event of a change the start date and/or time or cancellation of the Booking by the Client, the Client will inform Prague Companions as soon as possible via telephone or email. Changes or cancellation less than 6 hours prior to the Booking must (also) be made by telephone.
12.2 A cancellation is only valid after the receipt of this has been confirmed by Prague Companions by instant message or telephone. If the Client does not communicate the cancellation at all to Prague Companions, this is considered a “No-Show” where the moment the Booking should have commenced is considered the moment of cancellation.
12.3 If the Booking is made with multiple Companions/Escorts, each Companion/Escort is considered a separate Booking.
12.4 If the Client wishes to change/cancel a Booking then the following applies;
New Client: Free of charge 6h prior to the planned Booking. After this, the Client owes 100% of the Booking Rate.
Known Client: Free of charge until 6h prior to the planed Booking. After this, the Client owes 25% of the Booking Rate, with a minimum of €250.
12.5 If the Client cancels a Booking involving Additional Services, all associated costs will be at the Client’s expense and there is no right to a refund. This amount is added to any other cancellation costs.
12.6 In case the arrival of the Client is delayed, the waiting time will not be part of the booking duration if the Client notifies Prague Companions before the Companion/Escort departs to the Booking. If the Companion/Escort has already departed to the Booking, but the original starting time of the Booking has not yet been reached, the first 15 minutes of waiting time will not be part of the booking duration. If the original starting time of the Booking has already passed, all waiting time is part of the booking duration.
12.7 In case the arrival of the Companion/Escort is delayed by 30 minutes or less, the Client has no right to cancel the booking. If the arrival of the Companion/Escort is delayed with more than 30 minutes, the Client can cancel the booking free of charge if:
The Booking confirmation did not take place less than 5 hours ago. The term of 5 hours only applies to hours during Opening hours (10AM-11PM CET).
The Client has not agreed to a new start time for the Booking.
12.8 In the event of a delayed arrival time of the Companion/Escort, the minimum booking duration does not change. The Client has no right to a lower minimum booking duration due to the delay.
12.9 The Client can cancel the booking free of charge within 10 minutes after the commencement of the Booking if in the opinion of the Client, in reality the Companion/Escort is not as presented on the Website, in terms of appearance or personality. This can be used once and only under the following conditions:
The Client has invested time and effort into evaluating if Companion/Escort is a match, for example by reading the profile of Companion/Escort.
There is no sudden unavailability and/or schedule change of the Client, which would make continuation of the Booking impossible.
The location of the Booking is within Prague area.
The Companion/Escort has not been touched, undressed or attempted to do so.
The Booking does not include any Additional Services.
The Client meets all the Client requirements as mentioned in Article 10 and the Booking meets all Booking requirements as mentioned in Article 9.
If no cancellation is indicated by the Client to Prague Companions and/or Companion/Escort within 10 minutes after the commencement of the Booking, the Booking is valid and finalized.
12.10 If the Client owes cancellation fee, she/he must provide it to the Companion/Escort (25% of the Booking Rate, with a minimum of €250) prior departure.
13.1 If one or more of the following applies, the Client will be regarded as a Faker in category A;
Prague Companions is provided with incorrect information regarding his/her person, contact details and/or the location of the Booking.
Repeated act in violation of Article 9 and/or 10.
The repeated placing of Assignments, without resulting in a Booking.
13.2 If one or more of the following applies, the Client will be regarded as a Faker in category B;
After a warning by Companion/Escort and/or Prague Companions, asking again for Companion/Escort’s personal contact details and/or offer Companion/Escort the own personal contact details.
Undertaking or any attempt to deception, fraud, intimidation and/or any other unlawful act towards Prague Companions and/or Companion/Escort.
13.3 Both Fakers in category A and B have a reduced right to privacy, as set out in our Privacy Statement. In the case of a Faker in category B, Article 18 (penalty clause) of these general terms and conditions also applies and the Client forfeits an immediately due and payable fine.
Article 14. Privacy and electronic security
14.1 All information of the Client which is available to Prague Companions on the basis of its provision of service will be treated confidentially and will only be used for the execution of the service as agreed in a Booking, as well as for optimising the service related to any future Bookings. For more information about your how we treat your privacy please refer to our Privacy Statement.
14.2 Prague Companions will (within reason) commit to protect the personal details of the Client, and will use third party expertise to do so. Unless in the event of intent or wilful recklessness by Prague Companions, Prague Companions cannot be held liable or responsible for the disclosure of these data.
14.3 This Website will use a secure (SSL) connection to send forms.
14.4 To provide an optimal service, we use cookies on this Website. Cookies are small text files that a web page may store on a PC, tablet or mobile phone. This cookie can be retrieved during a later visit to the same site. The cookie cannot be read by a Website other than the one that created it. The cookies used by this Website are anonymous. Article 15. Liability and Force Majeure
15.1 Prague Companions cannot be held liable for direct or indirect damage caused by the use of this Website or through the by this Website provided information.
15.2 Unless in the case of intent or major neglect, Prague Companions and its Companions/Escorts are not liable for any damage resulting from the execution of Bookings, or related to Bookings, regardless whether the claim is based on another agreement or legal foundation.
15.3 Defects of whatsoever nature, disappointed expectations on the part of the Client, information on the Website or derogations from the information provided on the Website will give no right whatsoever to compensation (of damage) and/or setoff. Prague Companions does not provide any guarantee towards the Client concerning the Client’s experience during the Booking, partly due to the very personal nature of the service.
15.4 If Prague Companions cannot, or cannot completely fulfil its obligations as a result of a cause or incident that cannot be attributed to Prague Companions, or due to any other circumstance that is beyond Prague Companions’ control, is force majeure and these obligations will be suspended until the time when Prague Companions is capable again of fulfilling its obligations on the basis of an Assignment or Booking.
If Prague Companions is unable to fulfil its obligations towards the Client within a reasonable period, both Prague Companions and the Client will have the right to cancel the Booking, by instant messaging, telephone or e-mail with read and receipt confirmation, without Prague Companions being obligated to compensate any damage on the part of the Client as a result of this cancellation.
If Prague Companions has already partially fulfilled its obligations or can only partially fulfil its obligations, Prague Companions will be entitled to separately charge the Client for the part of the Booking that has already been executed, and the Client will be obligated to pay this amount.
Article 16. Copyright, Trademark and other Intellectual Property Protection
16.1 The names Prague Companions-related marks depicted on this Website, whether registered or unregistered, are trademarks or service marks of Prague Companions.

In the event of violation of the provisions as included in these general terms and conditions, without any notice or notice of default being required, the Client will forfeit in favour of Prague Companions an immediately due and payable fine of €2,000 (in words: two thousands euros) for each violation and an immediate payable fine of €1,000 (in words: one thousand euros) for each day that the violation continues, without prejudice to Prague Companions’ right to claim fulfilment and/or compensation from the Client for the additional damage suffered and yet to be suffered.

Article 20. Applicable law and choice of forum
Czech law exclusively applies to all Assignments, Bookings and these Terms and Conditions. All disputes arising in connection with these Terms and Conditions, Assignments and Bookings that may arise, including disputes about the applicability and validity thereof, shall be settled by the Arbitration Court at the Czech Chamber of Commerce and the Czech Agrarian Chamber according to its rules by three (3.) arbitrators. The place of the meeting will be Prague and the communication be in Czech language.
